 The Telangana High Court has made it clear that those who go to another family for adoption will lose their property rights at birth.  It is stated that the same person cannot be a member of two families and in that case there is no right in the property.

It has been said that before going for adoption, the property is transferred and shares are allotted and only if the adopters are allotted shares, they will have the right to that property only. A key ruling held that if there is no allocation before adoption, the adoptee will not have any share in the property belonging to the birth family.

AVRL Narasimha Rao of Konijerla Mandal of Khammam District approached the Khammam Civil Court claiming that even if the adoption goes away, his birth family will have a share in the property. The court that inquired into this gave a verdict that Narasimha Rao will have a share in the property of the family in which he was born. Challenging this verdict, Narasimha Rao’s brother A Nageswara Rao and other family members filed an appeal in the High Court. A full bench of Telangana High Court Judges Justice P Naveen Rao, Justice B  Vijaysen Reddy and Justice Nagesh Bhimapaka examined the matter  and after hearing the arguments of both sides, the judgment was passed recently.
